[PROPOSED] ORDER
WHEREAS, on June 23, 2021, plaintiff BMO Harris Bank N.A. (“Plaintiff') commenced this action by filing a verified complaint (the “Verified Complaint”) against defendant Joseph Shepherd (“Defendant”) seeking the repayment of certain equipment financing loans, as evidenced by the Loan Agreements. EOF No. 1;
WHEREAS, the Court granted Plaintiff s Request for Entry of Default against Defendant by Order dated December 21, 2021 and duly entered in the office of the Clerk of the Court on December 21, 2021 (the “Default Judgment Order”). EOF No.s 9, 10;
WHEREAS, on December 28, 2021, Plaintiff moved for Default Judgment. ECF No. 11.
WHEREAS, Defendant was provided due and proper notice and the opportunity to be heard,
NOW THEREFORE, upon the Motion for Default Judgment of Reed Smith LLP, attorneys for plaintiff BMO Harris Bank N.A., it is hereby:
ORDERED and ADJUDGED that Plaintiff BMO Harris Bank N.A. shall have judgment and recover from Defendant Joseph Shephered (i) in the sum of for $380,048.53, together with prejudgment interest in the amount of $77,826.44 as of December 13, 2021, together with a per diem interest rate of $190.02 for every day after December 13, 2021, reasonable attorney's fees of $2,984, costs of suit of $554.25, and that the judgment bear interest at the judgment rate from the date of entry until paid.
