District Court of Appeal of Florida, Fourth District
May 5, 1982
413 So. 2d 479 (Fla. Dist. Ct. App. 1982)

Opinion

No. 80-2212.

May 5, 1982.

Appeal from Circuit Court, Broward County; Mark E. Polen, Judge.

Richard L. Jorandby, Public Defender, and Charles D. Peters, Asst. Public Defender, West Palm Beach, for appellant.

Jim Smith, Atty. Gen., Tallahassee, and Stewart J. Bellus, Asst. Atty. Gen., West Palm Beach, for appellee.

AFFIRMED.

DOWNEY and HURLEY, JJ., concur.

ANSTEAD, J., specially concurs with opinion.

I agree that the trial court's determination that the appellant waived his right to have formal charges lodged against him within 45 days is supported by the record. On the issue of waiver of counsel I concur on the authority of Jordan v. State, 334 So.2d 589 (Fla. 1976).
