IN THE MATTER OF DAVID M. BLY, PETITIONER, v. HON. M. WILLIAM BOLLER, ACTING SUPREME COURT JUSTICE, RESPONDENT.


PRESENT:

Respondent having moved to dismiss this CPLR article 78 proceeding commenced in this Court for failure to obtain personal jurisdiction, and, in the alternative, having moved for an extension of time to file and serve an answer and a certified transcript of the record and for other relief,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion insofar as it seeks to dismiss the proceeding is denied, and

It is further ORDERED that the motion is otherwise granted to the extent that the scheduling order is amended such that respondent's answer and certified transcript of the record shall be filed and served on or before October 9, 2020, petitioner's brief shall be filed and served on or before November 13, 2020, respondent's brief shall be filed and served on or before December 18, 2020, and this proceeding shall be removed from the Court's day calendar for December 1, 2020, and added to the term commencing February 22, 2021.
