The order appealed from should be modified by denying the motion requiring the defendant to furnish the particulars specified in the notice therefor, except the 18th, 19th and 20th demands, as to which a bill of particulars is required, and as so modified affirmed, without costs to either party.


Order modified as directed in opinion, and as modified affirmed, without costs.
