Bluehorse v. Reno Mun. Court

COURT OF APPEALS OF THE STATE OF NEVADA

No. 75128 (Nev. App. Oct. 9, 2018)

Opinion

AKENATEN BLUEHORSE, Petitioner, v. RENO MUNICIPAL COURT; AND TAMMY M. RIGGS, RENO MUNICIPAL COURT JUDGE, Respondents.

ORDER DENYING PETITION

This original petition for a writ of mandamus seeks an order directing the municipal court judge to vacate a February 1, 2018, order. Akenaten Bluehorse asserts the municipal court judge abused her discretion and violated his right to access the court by concluding his post-conviction motions were fugitive documents and declining to consider them.

We have considered the petition, and we are not satisfied this court's intervention by way of extraordinary writ is warranted. See NRS 34.160; Pan v. Eighth Judicial Dist. Court, 120 Nev. 222, 228, 88 P.3d 840, 844 (2004) ("Petitioner[ ] carr[ies] the burden of demonstrating that extraordinary relief is warranted."). Accordingly, we

ORDER the petition DENIED.
