This case was set for trial at the Tax Court's trial session in St. Louis beginning October 24, 2022. Petitioners filed a pretrial memorandum (Doc. 11) and proposed trial exhibits (Docs. 12-16). They then filed a motion to proceed remotely, alleging that they are "[d]isabled. Travel and sitting for the time required is not possible." Respondent filed a response (Doc. 20), objecting to the motion. The Court attempted to schedule a telephone conference to determine the merits of the motion, but because of scheduled leave, the Columbus Day holiday, and training, counsel for the Commissioner is unable to participate before October 17, 2022. Since we cannot delay until October 17, 2022, the question whether trial will proceed on October 24, 2022, it is

ORDERED that the motion to proceed remotely is granted. This case is stricken from the calendar of the upcoming trial session and is restored to the general docket, to be added to the next available remote trial session.
