Bleasdell v. Underwriters Guar. Ins. Co.

District Court of Appeal of Florida, First District
Sep 30, 1996
679 So. 2d 1309 (Fla. Dist. Ct. App. 1996)

Opinion

No. 95-4127.

September 30, 1996.

An appeal from the circuit court for Duval County; Michael Weatherby, Judge.

Charles R. Steinberg, Orlando, for Appellants.

Robert H. Sturgess of Bateman Graham, P.A., Jacksonville, and Paul M. Harden, Jacksonville, for Appellee.

Finding no abuse of discretion, we affirm the lower court's denial of Appellants' motion to change venue. Our affirmance, however, is without prejudice to Appellants to file a new motion for change of venue should Barnett Bank of Jacksonville be dismissed as an improper party. AFFIRMED.

The record suggests that Barnett Bank of Central Florida may be the proper party.

BOOTH, JOANOS and VAN NORTWICK, JJ., concur.
