It is Ordered that the motion of the petitioner-appellant is granted on condition that the petitioner-appellant perfect its appeal by no later than the November 2015 term the filing deadline for which is September 10, 2015.The conditional stay is granted solely to the extent of staying the respondent's restoration to the premises pending the determination of the appeal. The order of Housing Court Judge Arlene Kahn dated June 29, 2015, directing the petitioner-appellant to immediately commence the restoration of the subject apartment to habitable condition remains in effect. In the event of the petitioner-appellant's failure to comply with the foregoing conditions, the respondent may move on five days notice for an order vacating the stay.
