ORDER

The motion for immediate consideration of the motion to file a late reply is GRANTED.

The motion to file a late reply is GRANTED and the proposed reply filed with that motion is accepted for filing.

The delayed application for leave to appeal is DENIED for failure to persuade the Court of the need for immediate appellate review.

The motion for appellate costs and attorney fees under MCR 3.206(D) is DENIED without prejudice to plaintiff mother seeking such relief in the circuit court. Although "appellate attorney fees may be awarded under MCR 3.206(D)," a party's entitlement to such an award is a fact-intensive inquiry that should be addressed by a trial court-not an appellate court-in the first instance. See generally Colen v Colen, 331 Mich.App. 295, 305-309; 952 N.W.2d 558 (2020) (emphasis added).
