ORDER

Courtney D. Jones Judge.

This case is on the calendar of the Court's April 15, 2024, trial session in Cleveland, Ohio. On January 2, 2024, respondent filed a Motion for Entry of Order that Undenied Allegations be Deemed Admitted Pursuant to Rule 37(c) (Doc. 12). Respondent moved under Tax Court Rule 37(c) that the undenied allegations in paragraphs 8, 9, and 10 of its answer be deemed admitted.

Upon due consideration, it is

ORDERED that petitioner file, on or before January 23, 2024, a reply as required by Rule 37(a) and (b). If petitioner fails to do so, the Court may grant respondent's motion, and the undenied allegations in the answer may be deemed admitted.
