This case is currently calendared for trial at the Court's Peoria, Illinois, trial session, which is scheduled to begin March 16, 2023. On February 15, 2023, respondent filed a Motion to Dismiss for Failure to Properly Prosecute. On February 24, 2023, the Court served an Order to Show Cause on petitioner instructing him to, on or before March 10, 2023, show cause in writing why respondent's Motion to Dismiss for Failure to Properly Prosecute filed February15, 2023, should not be granted and a decision entered against petitioner for the amounts and year set forth in respondent's Motion. On March 9, 2023, respondent filed a Status Report with the Court indicating that a settlement in this case had been reached and that they expect to submit to the Court a fully stipulated decision resolving this case. Upon due consideration, it is hereby
ORDERED that the Court's Order to Show Cause served February 24, 2023, is discharged. It is further
Ordered that respondent's Motion to Dismiss for Failure to Properly Prosecute is denied as moot. It is further
ORDERED that, on or before April 17, 2023, the parties shall submit to the Court either a stipulated decision or file a joint report (or separate reports, if preferred) regarding the then-present status of this case. It is further
