Opinion

No. 118935 (54).

April 30, 2002.

COA: 221494, Ingham CC: 98-088770-CZ

By order of October 23, 2001, the Insurance Commissioner was directed to file a supplemental brief on the question of whether, pursuant to MCL 550.1502(8), an "evidence of need" determination on the part of a health care corporation constitutes a "reasonable standard" that may be set by such corporation in assessing whether to grant participating provider status to a freestanding surgical outpatient facility which otherwise complies with the requirements of MCL 550.1502(8). On order of the Court, the briefs having been filed, the application for leave to appeal from the January 19, 2001 decision of the Court of Appeals is again considered, and it is GRANTED.

Persons or groups interested in the determination of the questions in this case may move the Court for permission to file briefs amicus curiae.
