Dec 7, 2010
Case No. SC10-1620 (Fla. Dec. 7, 2010)

Opinion

Case No. SC10-1620.

December 7, 2010.

Lower Tribunal No(s). 1D10-3473, 16-1999-CF-5262-A.

Because petitioner has failed to show a clear legal right to reinstatement of the petition for writ of habeas corpus in Case No. 1D10-3473, he is not entitled to mandamus relief. Accordingly, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So. 2d 10, 11 (Fla. 2000).

LEWIS, QUINCE, POLSTON, LABARGA, and PERRY, JJ., concur.
