PROPOSED ORDER

Petitioner has filed a petition for writ of mandamus and to invoke the Court's all writs jurisdiction. Because it appears that petitioner is seeking a declaratory judgment, the Second Judicial Circuit Court, in and for Leon County, appears to be a more appropriate forum for this case. Therefore, under Rule 9.040(b) of the Florida Rules of Appellate Procedure, this case is hereby transferred to that court as of this date. The transferee court shall treat the petition as if it had been originally filed there on the date it was filed in this Court. The transfer of this case is not an adjudication or comment on the merits of the petition, nor is it a determination concerning the transferee court's jurisdiction or the proper denomination of the pleading to be filed in that court.
