Blair v. O'Leary

Appeals Court of Massachusetts
Feb 28, 2003
784 N.E.2d 50 (Mass. App. Ct. 2003)

Opinion

No. 01-P-1019.

February 28, 2003

The judgment is vacated insofar as it (i) orders reinstatement of the plaintiff prior to completion of an approved retraining program and (ii) awards compensatory damages in the form of back pay and other benefits, premised on reinstatement occurring prior to completion of retraining. A provision is to be added to the judgment declaring that the plaintiff is to be reinstated to his former position subject to his successful completion of a retraining program. As so modified, the judgment is affirmed.
