ORDER

Maurice B. Foley Chief Judge.

On August 5, 2021, the Court entered its Order of Dismissal for Lack of Jurisdiction due to petitioner's failure to pay the filing fee, and this case was closed. On September 7, 2021, petitioner lodged an Application for Waiver of Filing Fee. For cause, it is

ORDERED that the Court's Order of Dismissal for Lack of Jurisdiction, entered on August 5, 2021, is hereby vacated and set aside. It is further

ORDERED that the Clerk of the Court shall file as of the date of this Order the application for waiver of filing fee lodged by petitioner. It is further

ORDERED that petitioner's Application for Waiver is granted and the filing fee in this case is waived. It is further

ORDERED that the time within which petitioner shall file a proper first amended petition, is extended to October 22, 2021. See Rule 34(b), Tax Court Rules of Practice and Procedure; Jarvis v. Commissioner, 78 T.C. 646, 658 (1982). If, by October 22, 2021, no amended petition is received, the Court may dismiss this case for lack of jurisdiction.
