95 So. 3d 212 (Fla. 2012)

Opinion

No. SC12–730.

2012-06-14

Hosea T. BLACKWELL, Petitioner(s) v. STATE of Florida, Respondent(s).

Because petitioner has failed to show a clear legal right to recall of the mandate issued by the Second District Court of Appeal, for Blackwell v. State case number 2D10–3602, he is not entitled to mandamus relief. Accordingly, the petition for writ of mandamus is hereby denied. See Huffman v. State, 813 So.2d 10, 11 (Fla.2000).

PARIENTE, LEWIS, QUINCE, POLSTON, and PERRY, JJ., concur.
