Peter BLACKMAN v. Joseph SAVINO, trustee, & others.

The statute protects the “ ‘exercise of [the] right of petition ...’ by creating a procedural mechanism, in the form of a special motion to dismiss, for the expedient resolution of so-called ‘SLAPP’ suits.” Office One, Inc. v. Lopez, 437 Mass. 113, 121 (2002), quoting from G.L. c. 231, § 59H. We review the grant of a G.L. c. 231, § 59H, special motion to determine whether an abuse of discretion or error of law appears. Moriarty v. Mayor of Holyoke, 71 Mass.App.Ct. 442, 445 (2008).
