DEAN C. BLACK, Defendant Below-Appellant, v. STATE OF DELAWARE, Plaintiff Below-Appellee. No. 144, 2003. Supreme Court of Delaware. Submitted: April 24, 2003. Decided: May 16, 2003.

Before VEASEY, Chief Justice, BERGER, and STEELE, Justices.

ORDER

Myron T. Steele, Justice:

This 16th day of May 2003, after careful consideration of the appellant's opening brief and the State's motion to affirm, we find it manifest that the judgment of the Superior Court should be affirmed. The Superior Court did not err in concluding that Black's motion for correction of sentence was both repetitive and untimely under Superior Court Criminal Rule 35(b).

NOW, THEREFORE, IT IS ORDERED that the judgment of the Superior Court is AFFIRMED.
