Jun 2, 1992
598 So. 2d 332 (Fla. Dist. Ct. App. 1992)

Opinion

No. 91-152.

June 2, 1992.

An Appeal from the Circuit Court for Bay County; Don Sirmons, Judge.

Nancy A. Daniels, Public Defender, P. Douglas Brinkmeyer, Asst. Public Defender, Tallahassee, for appellant.

Robert A. Butterworth, Atty. Gen., Suzanne G. Printy, Asst. Atty. Gen., Tallahassee, for appellee.

Roger Black appeals his guideline sentence and order of restitution for the offense of burglary with a battery. We affirm the sentence, except that portion relating to restitution, which we vacate, in that it is a duplication of the restitution ordered in case number 90-1517, which arises from the same transaction as the instant case.

AFFIRMED IN PART, VACATED IN PART.

ERVIN, WIGGINTON and KAHN, JJ., concur.
