[PROPOSED] ORDER VACATING DEFAULT JUDGMENT AND DISMISSING CASE WITHOUT PREJUDICE


This matter comes before the Court on Plaintiff's Motion to Vacate Default Judgment and Motion to Dismiss. For the reasons set forth in Plaintiff's motion and supporting memorandum, it is HEREBY ORDERED that the Default Judgment against Defendants Dutson-Wignall, Inc., William R. Wignall, Jr. and Kylei B. Wignall ("Defendants") and in favor of Black Rock Capital, L.L.C., which Default Judgment is dated May 4, 2004, be VACATED and the matter DISMISSED without prejudice.
