ORDER


On November 13, 2003, Plaintiff Black Diamond Equipment, Ltd. filed its "Supplemental Memorandum in Opposition to Defendant's Motion to Dismiss." (See Dkt. #17.) Plaintiff did not request leave of the court, as required by the local rules, to file this memorandum. DUCivR 7-1(b)(3) ("No additional memoranda will be considered without leave of court"). Then on November 26, 2003, Defendants filed a response, accompanied by a motion for leave to file the response. (See Dkt. #18 19.)

The court finds that Plaintiffs memorandum is clearly not permitted by the DUCivR 7-1(b)(3), as noted above. Accordingly, the court will not consider it. Moreover, although Defendants properly requested leave to file their response, the court finds the response unnecessary and DENIES leave to file. The Clerk of the Court is directed to lodge, and not to file, these three documents.

SO ORDERED.
