BEHAILU ZELEKE BIRKIE, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 199th Judicial District Court Collin County, Texas Trial Court Cause Nos. 199-84662-2022, 199-84663-2022, 199-84664-2022

ORDER

NANCY KENNEDY, JUSTICE.

Appellant's brief is overdue. Appellant's brief was originally due January 29, 2024. On February 5, 2024, appellant filed a motion for extension of time to file the brief. This Court granted the motion for extension and ordered appellant's counsel, Mitchell Nolte, to file appellant's brief by February 27, 2024. As of the date of this order, Mr. Nolte has not filed appellant's brief or a second motion for extension of time to file the brief.

We ORDER Mitchell Nolte to file appellant's brief on or before MAY 28, 2024. If appellant's brief is not filed by that date, this Court may abate the appeals for the trial court to make findings why appellant's brief has not been filed in accordance with Rule of Appellate Procedure 38.8(b)(2).
