Suit by Sarah J. Bird against Harry B. Harkins and others. Exceptions to the report of the referee overruled, and the report confirmed.

MAGIB, Ch. The practice adopted in this case seems somewhat unusual. There was a cross-bill, and answer thereto, yet the matters were referred to a master. The parties appeared and presented their case before him, and they, or some of them, have excepted to his report. The exceptions were brought to hearing, and no objection to their consideration was made. They have therefore been examined and considered. The evidence returned by the master, in my judgment, justifies the conclusion he reached. The exceptions must therefore be overruled, and the report confirmed.
