ORDER OF DISMISSAL WITHOUT PREJUDICE


WHEREAS, a pre-trial conference was held in this case on October 29, 2002 and the Plaintiff failed to appear,

and WHEREAS, in response to the Defendant's Motion to Dismiss the complaint, Plaintiff indicated his willingness to dismiss the case voluntarily, without prejudice, in order to pursue administrative remedies, and WHEREAS, the Court has received Plaintiff's Notice of Withdrawal (a copy of which is attached) acknowledging that administrative remedies must be exhausted before bringing this action, and asking for dismissal without prejudice, Plaintiff's request is hereby granted, and this matter is dismissed without prejudice.

IT IS SO ORDERED.
