ORDER RE-NOTING HEARING DATE


This habeas corpus petition has been referred to the undersigned Magistrate Judge pursuant to 28 U.S.C. § 636 (b) and local Rules MJR 3 and 4. The Court, having reviewed the petitioner's Motion to Re-note the hearing date in this petition does now find and ORDER:

(1) The respondents noted this matter for hearing on January 31st, 2002 instead of 2003.
(2) The petitioner objects and attempts to re-note the matter for February 28th, 2003.
(3) To ensure that the petitioner is not harmed by the typographical error in the noting date, this matter is re-noted for four weeks from the date of this ORDER, February 13th, 2003.
(4) Petitioner's reply to the answer is due on or before February 12th, 2003.
(5) The Clerk is directed to send copies of this Order to petitioner and counsel for the on February 13th 2003
