DEFENDANT'S DOCKETING STATEMENT
Defendant Reliance Standard Life Insurance Company (“Reliance Standard”), by its undersigned attorney, hereby submits the following Docketing Statement pursuant to Circuit Rule 3(c)(1), and states as follows:
1. The District Court had jurisdiction over the parties and over the subject matter of this action pursuant to 28 U.S.C. §1331 and 29 U.S.C. §§1132(e)(1), (f), as this suit involved a claim for long-term disability benefits sought under an employee welfare benefit plan governed by the Employee Retirement Income Security Act of 1974, 29 U.S.C. §1001 et seq. (“ERISA”). Plaintiff brought suit pursuant to 29 U.S.C. §1132(a)(1)(B) against Reliance Standard, seeking long term disability benefits under an employee welfare benefit plan sponsored and maintained by her employer, with long term disability benefits funded by a group insurance policy issued by Reliance Standard.
2. On March 24, 2022, the District Court issued a Memorandum Opinion and Order (R. 40) granting Plaintiff's Motion for Summary Judgment and denying Reliance Standard's cross-motion for summary judgment. A final judgment was issued the next day, on March 25, 2022. (R. 42)
3. The U.S. Court of Appeals for the Seventh Circuit has jurisdiction over this appeal pursuant to 28 U.S.C. §1291 and Fed. R. App. P. 3 and 4, as a timely notice of appeal was filed in this matter on April 18, 2022.
