BY ORDER OF THE COURT.

In appeal 2D13–5420, the appellant/petitioner filed a notice of appeal reciting that he wished to challenge an October 18, 2013, “order denying relief of order.” Subsequently, in response to this court's order to show cause and after being granted an extension of time, the appellant/petitioner filed in appeal 2D13–5420 a copy of the October 18, 2013, “order denying petitioner's motion for relief of order and/or in the alternative notice of direct appeal.” Appeal 2D13–5420 is proceeding on the basis that it will review this order.

In proceeding 2D13–6037, the appellant/petitioner seeks review of the same order. In response to this court's order to show cause on timeliness issued in 2D13–6037, the petitioner appears to be asserting that he intended appeal 2D13–5420 to review an order on mandamus entered by the circuit court. However, the petitioner's filings in this court do not mention this order.

Appeal 2D13–5420 will proceed to review the October 18, 2013, “order denying petitioner's motion for relief of order and/or in the alternative notice of direct appeal.” Proceeding 2D13–6037 is hereby dismissed as duplicative of appeal 2D13–5420.
