Biggs v. Willson

Supreme Court of Florida, Division A
Sep 23, 1952
60 So. 2d 399 (Fla. 1952)

Opinion

August 1, 1952. Rehearing Denied September 23, 1952.

A Writ of Certiorari to Circuit Court, Lake County; T.G. Futch, Judge.

Walton Walton, Kate L. Walton and J.V. Walton, Palatka, for petitioners.

Ellis F. Davis, Kissimmee, Edward R. Kirkland, Orlando, and Z.D. Giles, Leesburg, for respondents.

It appearing that the respondents have no such interest as justifies their bringing suit for injunction against the petitioners, the certiorari is granted and the order denying the motion to dismiss is quashed and the chancellor is directed to dismiss the cause and dissolve the injunction. See Rickman v. Whitehurst, 73 Fla. 152, 74 So. 205; State ex rel. Clarkson v. Phillips, 70 Fla. 340, 70 So. 367.

SEBRING, C.J., and TERRELL, THOMAS and HOBSON, JJ., concur.
