ESTATES OF DECEDENTS, § 198when plaintiff's performance of alleged oral contract with decedent was not proved. In action to compel specific performance by administrator of alleged oral contract between plaintiff and decedent whereby decedent was to bequeath his entire estate to plaintiff in return for her personal services in caring for him, and it appeared that plaintiff did not resign from her position at time she was obligated to do so under terms of contract, held that plaintiff's complaint was properly dismissed for want of equity.

Appeal from the Circuit Court of Cook county; the Hon. PHILIP J. FINNEGAN, Judge, presiding.

Affirmed. Heard in the second division, first district, this court at the June term, 1945.
