IN THE MATTER OF JENNIFER BIANCHINE, PETITIONER, v. NEW YORK STATE OFFICE OF CHILDREN AND FAMILY SERVICES, NEW YORK STATE CENTRAL REGISTER OF CHILD ABUSE AND MALTREATMENT AND ERIE COUNTY DEPARTMENT OF SOCIAL SERVICES, RESPONDENTS.


PRESENT: , J.P., FAHEY, CARNI, SCONIERS, AND WHALEN, JJ.

Respondent New York State Office of Children and Family Services having moved for an extension of time to file and serve a brief on this CPLR article 78 proceeding transferred to this Court by order of the Supreme Court entered in the Office of the Clerk of the County of Erie on September 14, 2012,

Now, upon reading and filing the affirmation of Allyson B. Levine, Esq., dated February 11, 2013, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the first ordering paragraph of the order of this Court entered January 30, 2013, is hereby amended by deleting the date February 13, 2013, and inserting in its place the date April 15, 2013, and the Clerk is directed to accept the brief for filing, and

It is further ORDERED that the second ordering paragraph of the order of this Court entered January 30, 2013, is hereby amended by deleting the date February 28, 2013, and inserting in it place the date April 30, 2013, and

It is further ORDERED that the appeal is removed from the Court's day calendar for April 9, 2013, and added to the calendar for the term of this Court commencing May 13, 2013.
