In Bey v. United States, 553 U.S. 1016 (2008), the Supreme Court granted her petition, vacated the order, and remanded the case to the Seventh Circuit for reconsideration in light of Gall v. United States, which made clear that "if the sentence is outside the Guidelines range, the [appellate] court may not apply a presumption of unreasonableness."
