These consolidated cases were called for remote trial on June 21 through June 25, 2021, at a Special Session of the Court. During that remote trial, four of the possible seventeen witnesses provided testimony with two of these four witnesses called to be recalled.
On June 28, 2021, this Court ordered the parties to each file a separate status report and outline therein: (1) the number of witnesses remaining that each party expects to call; (2) an estimate of the needed trial days required to complete the remote trial in these consolidated cases, including all factual and expert witness (assuming no oral closing arguments); and (3) the parties' respective availability commencing Monday the week of July 19, 2021, through Monday the week of December 6, 2021, for the scheduling of these consolidated cases for remote trial at a Special Session of the Court.
On September 7, 2021, respondent filed a Status Report representing that respondent is not available for a two-week trial commencing between the weeks of October 18 and December 6, 2021.
On September 16, 2021, respondent filed a Motion for Leave to File First Supplemental Status Report and lodged the First Supplemental Status Report. Respondent represented that respondent's availability for trial has changed. Respondent is now available for a two week trial commencing the weeks of either November 29 or December 6, 2021. Additionally, respondent represents that petitioners have no objection to the granting of respondent's motion for leave.
Upon due consideration and for cause, it is
ORDERED that respondent's Motion for Leave to File First Supplemental Status Report filed September 16, 2021, is granted and that the Clerk of the Court shall file the First Supplemental Status Report lodged September 16, 2021, as of the date of service of this Order.
