Berwick v. State of New York

Court of Appeals of the State of New York
Sep 19, 1990
562 N.E.2d 869 (N.Y. 1990)

Opinion

Submitted June 4, 1990

Decided September 19, 1990

Motion for leave to appeal denied. The Court of Appeals restates the rule that denial of a motion for leave to appeal is not equivalent to an affirmance and has no precedential value (see, e.g., Matter of Marchant v Mead-Morrison Mfg. Co., 252 N.Y. 284, 297-298 [Cardozo, Ch. J.]; Matter of Michael P. v Diana G., 75 N.Y.2d 1003).
