This case was calendared for trial at the Court's May 18, 2020, Chicago, Illinois trial session. Due to concerns relating to COVID-19, the trial session was canceled, and this case was assigned to Judge Patrick J. Urda.
On May 13, 2021, the Court directed petitioners Ezio and Allison Berrettini to file a status report updating the Court as to the current status of this case by June 4, 2021. They have not done so. We warned in our Order that if the Berrettinis did not file a response, that we would take appropriate remedial action, which may include dismissal for lack of prosecution. We nonetheless will give the Berrettinis one more chance.
The Court will add this case to its September 20, 2021, trial session where San Diego, California is listed as the place of trial. Because all trial sessions are being conducted remotely, this place of trial is for administrative purposes only.
Upon due consideration, it is
ORDERED that this case is calendared for trial during the Court's September 20, 2021, San Diego, California, trial session to be conducted remotely, which is scheduled to begin 10:00 a.m. (Pacific Time)/12:00 p.m. (Central Time). It is further
ORDERED that the Clerk of the Court shall also serve on the parties: (1) a Notice of Remote Proceeding that shall contain comprehensive instructions on how to participate in the Court's September 20, 2021, San Diego, California, trial session, (2) a copy of the Standing Pretrial Order for the Court's September 20, 2021, San Diego, California, remote trial session, and (3) a clinic letter for Chicago, Illinois.
