Motion by respondent to vacate an order of this court dated November 4, 2016, which granted an application by appellant to enlarge the time to perfect an appeal from a judgment of the Civil Court of the City of New York, Kings County, entered July 25, 2013, and to dismiss the appeal with prejudice.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is
