BY ORDER OF THE COURT.

As it appears that the petitioner is represented by counsel in the proceeding in the trial court, the petition for writ of mandamus is dismissed. See Logan v. State, 846 So.2d 472 (Fla.2003).

Petitioner's Motion to Dismiss is denied as moot.
