DECISION & ORDER ON MOTION

Appeal from an order of the Supreme Court, Nassau County, dated September 2, 2021. Motion by the appellant, inter alia, for leave to appeal to this Court from the order dated September 2, 2021, and to stay enforcement of an order and judgment of the same court issued in a related case entitled Retained Realty, Inc., v Bernardin, under Index No. 607139/2017, as well as his eviction from the subject premises, pending hearing and determination of the appeal from the order dated September 2, 2021.

Upon the papers filed in support of the motion and the papers filed in opposition thereto, it is ORDERED that the branch of the motion which is for leave to appeal is denied; and it is further, ORDERED that the appeal purportedly taken as of right is dismissed, without costs or disbursements; and it is further, ORDERED that the motion is otherwise denied as academic.
