Alan Michael Berkun Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Patrick J. Urda Judge.

This case is currently set for a status conference during the Court's Nashville, Tennessee, trial session, which is scheduled to begin on February 28, 2022.

Pending before the Court is petitioner Alan Michael Berkun's motion to compel production of documents, filed September 1, 2021. (Doc. 40.) On September 17, 2021, the Commissioner filed a response to the motion to compel production of documents (Doc. 47), and a supplement to his response on October 8, 2021 (Doc. 56).

The Commissioner filed a status report on November 10, 2021, which informed the Court that the U.S. District Court for the Southern District of Florida had apparently granted the motion to disclose Rule 6(e) Order in U.S. Tax Court. The Commissioner requests additional time (until November 29, 2021) to determine if there are any limitations on disclosure and to file a second supplemental response to petitioner's motion to compel production of documents. We will grant that relief. Accordingly, it is

ORDERED that, on or before November 29, 2021, the Commissioner shall file a second supplement to his response to petitioner's motion to compel production of documents.
