In an action by the plaintiff husband for a marriage annulment based on the fraud of his wife, wherein the defendant wife asserted a counterclaim for a judicial separation based on the husband's abandonment, the plaintiff appeals from a judgment of the Supreme Court, Nassau County, rendered June 15, 1961, upon the decision of the court, after a nonjury trial, which (1) dismissed his complaint on the merits, (2) granted a separation to his wife on her counterclaim, (3) declared him to be the father of her child, and (4) directed him to make various payments for alimony, support of the child, counsel fee, etc. Judgment affirmed, with costs.
