Upon due consideration of respondent's Motion to Proceed Remotely, filed February 29, 2024, and the record of this case, it is

ORDERED that respondent's motion is denied.

Unless the parties submit a proposed stipulated decision on or before April 2, 2024, the Court expects to call this case at the trial session scheduled to commence at 10:00 AM on Thursday, April 4, 2024, in the U.S. District Court, William L. Guy Federal Building, 220 E. Rosser Ave., #476, Bismarck, North Dakota 58501. Should the Motion to Dismiss for Lack of Prosecution filed February 22, 2024, be denied, the Court expects that the parties will be prepared for trial.
