Benoit v. Werner

Appeals Court of Massachusetts
Jan 18, 2002
761 N.E.2d 550 (Mass. App. Ct. 2002)

Opinion

No. 99- P-2116.

January 18, 2002.

The judgments of dismissal are vacated and the determinations of the tribunal as to Dr. Werner, nurse Johnston, and Brockton Hospital, insofar as its liability would be based on the conduct of nurse Johnston, are to be replaced by a decision that the plaintiff's offer of proof, if properly substantiated, is sufficient to raise a legitimate question of liability appropriate for judicial inquiry.
