Supreme Court of Florida.
Jun 14, 2012
95 So. 3d 212 (Fla. 2012)

Opinion

No. SC12–539.

2012-06-14

Jeannine BENOIT o/b/o Joseph BENOIT, Petitioner(s) v. Christine YATES, etc., Respondent(s).

The petition for writ of habeas corpus is hereby denied. To the extent the petitioner raises the same issues as in Jeannine Benoit o/b/o Joseph Benoit v. State of Florida, Case No. SC 10–761, in which the petition was dismissed, the petition is denied as a repetitive petition. Cf. Topps v. State, 865 So.2d 1253 (Fla.2004). To the extent the petitioner seeks removal of the present guardian ad litem for Ward Joseph Benoit, the petition is denied without prejudice to the petitioner filing an appropriate motion with the Circuit Court of the Seventeenth Judicial Circuit in and for Broward County, Florida.

PARIENTE, QUINCE, POLSTON, LABARGA, and PERRY, JJ., concur.
