ORDER DISMISSING ACTION WITH LEAVE TO REFILE IN STATE COURT


On August 8, 2003, the Court dismissed plaintiffs' complaint, with leave to amend the complaint to assert a basis for federal jurisdiction. The Court ordered that if plaintiffs did not file-an amended complaint within 21 days from the date of the order, the complaint would be dismissed without prejudice to plaintiffs refiling their claims in state court. Plaintiffs have not filed an amended complaint.

Accordingly, the complaint is DISMISSED, without prejudice to refiling in state court. The clerk will close the file.

IT IS SO ORDERED.
