Motion by the appellant George J. Askew for leave to prosecute an appeal from an amended order of the Supreme Court, Orange County, dated November 29, 2011, as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the motion is denied.

We note that Patricia Askew must appear either pro se or by an attorney (see CPLR 321[a]).
