ORDER DENYING MOTION FOR PARTIAL RECONSIDERATION OF ORDER DENYING REQUEST FOR ATTORNEYS' FEES AND GRANTING IN PART REQUEST FOR COSTS


The motion for reconsideration filed on January 9, 2002 by the defendant-appellant Donald Muneo Kida requesting that this court review its order denying his counsel's request for attorney's fees and granting in part his request for costs, filed on December 28, 2001, is hereby denied because it is untimely. See Hawai`i Rules of Appellate Procedure Rule 40(a) (2000) (prescribing that a motion for reconsideration of a dispositional order is to be filed within ten days of the filing of the order).
