Pursuant to the Alabama Supreme Court's decision in Ex parte Bender, 557 So.2d 806 (Ala. 1989), this case is remanded to the circuit court in order for a hearing to be held on the appellant's petition.

REMANDED WITH INSTRUCTIONS.
