Bend `N Stretch, Inc. v. Reiner

District Court of Appeal of Florida, Third District
Nov 4, 1998
No. 98-556 (Fla. Dist. Ct. App. Nov. 4, 1998)

Opinion

No. 98-556.

Opinion filed November 4, 1998.

An Appeal from the Circuit Court of Dade County, Robert P. Kaye, Judge. L.T. No. 96-5645.

Sandler Travis Rosenberg and Edward M. Joffe; Cohen, Chase Hoffman and Robert M. Sondak, for appellant.

Ullman Ullman and Michael W. Ullman (Fort Lauderdale); Richard A. Warren, for appellee.

Before NESBITT, GODERICH and SHEVIN, JJ.

After carefully reviewing the record, we find that the trial court properly interpreted the terms of the underlying employment contract. Further, although conflicting evidence was presented regarding the amount of commission owed to the plaintiff, the trial court's determination was clearly supported by substantial, competent evidence. See Espino v. Anez, 665 So.2d 1080, 1081-82 (Fla. 3d DCA 1995).

Accordingly, we affirm.

NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION AND, IF FILED, DISPOSED OF.
