On Remand From The Alabama Supreme Court


On the authority of Ex parte Belue, [Ms. 1970121, September 11, 1998] ___ So.2d ___ (Ala. 1998), the judgment is reversed and this case is remanded to the circuit court for compliance with the instructions of the Alabama Supreme Court for the circuit court to vacate its order denying Belue's motion for a new trial and to conduct a second hearing with Belue present.

REVERSED AND REMANDED WITH INSTRUCTIONS.
