SANTOS MARTINEZ BELTRAN, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the Criminal District Court No. 5 Dallas County, Texas
Trial Court Cause Nos. F12-54606-L , F12-56353-L

ORDER

Before the Court is appellant's pro se motion requesting enforcement of the Court's July 6, 2017 order requiring preparation and transmission of redacted versions of the clerk's and reporter's records for appellant to use in preparing his pro se response to counsel's Anders brief. The Court GRANTS appellant's motion.

In the Court's July 6, 2017 order, the court directed the trial court clerk and court reporter to prepare the redacted records and transmit them to counsel within thirty days. In turn, counsel was directed to transmit the redacted records to appellant and to file, within forty days of the date of the order, a written verification that counsel had sent appellant the records. To date, the Court has not received a verification of compliance from counsel. In his motion, appellant states that he has not received the records.

We ORDER appellate counsel Lawrence B. Mitchell to file, within FOURTEEN DAYS of the date of this order, written verification that he has mailed redacted copies of the clerk's records and reporter's record to appellant as directed in the Court's July 6, 2017 order. If Mitchell does not provide the verification within fourteen days, these appeals will be abated for a hearing in the trial court to determine why appellant has not received access to the appellate record.

We DIRECT the Clerk to send copies of this order, by electronic transmission, to the Honorable Carter Thompson, Presiding Judge, Criminal District Court No. 5; Debi C. Harris, deputy official court reporter, Criminal District No. 5; Felicia Pitre, Dallas County District Clerk; Lawrence B. Mitchell; and the Dallas County District Attorney's Office.

We DIRECT the Clerk to send a copy of this order, by first-class mail, to Santos Martinez Beltran, #2120646, McConnell Unit, 3001 S. Emily Drive, Beeville, Texas 78102.
